Terms of Service

Welcome to MyBlak. These Terms of Service govern your use of www.myblak.com and all related products, services, content, and features made available through the MyBlak platform, including Travel & Tours, Marketplace, MyBlak TV, Language Hub, True Identity, Research Portal, and Correspondents features.
By creating an account, accessing the platform, booking a service, purchasing a product, listing as a vendor, or otherwise using MyBlak, you agree to these Terms.
1. Who We Are
MyBlak is a digital platform that connects users with travel vendors, marketplace vendors, curators, correspondents, and content experiences centered on Africa and the global Black community. Unless expressly stated otherwise, MyBlak acts as a technology platform and intermediary and does not itself own or directly operate third-party travel services, accommodations, transportation services, or third-party goods listed on the platform.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the platform or enter into any booking or transaction through MyBlak. By using the platform, you confirm that you meet these requirements.
3. Accounts and Registration
You may be allowed to register as a traveler, vendor, curator, correspondent, or another approved role. You agree to provide accurate information, keep your account credentials secure, and remain responsible for all activity under your account.
4. Platform Services
MyBlak may provide access to the following:
- Travel booking and itinerary services
- Curated trips and social sharing features
- Marketplace transactions
- Educational and cultural content
- Identity, map, and ancestry-related discovery features
- Messaging, wallet, loyalty, and booking support tools
Some platform features may be subject to role-based, subscription-based, or location-based restrictions.
5. Payments, Escrow, and Refunds
Payments may be processed through third-party payment processors. For some transactions, MyBlak may hold or route funds through escrow-like workflows, release payouts after fulfillment conditions are met, and apply platform fees, curator commissions, or service charges.
Refund eligibility depends on the relevant cancellation policy, vendor terms, booking terms, and dispute outcome, where applicable.
6. Marketplace Transactions
Marketplace vendors are independently responsible for product accuracy, legality, fulfillment, quality, shipping, and post-sale support, except where MyBlak expressly states otherwise.
7. Travel and Tour Services
Travel vendors, tour operators, accommodation providers, transport providers, guides, curators, and related service providers are independently responsible for the travel services they provide. MyBlak is not responsible for operational failures, safety incidents, government travel restrictions, missed flights, weather disruptions, or third-party service failures except to the extent required by law.
8. User Conduct
You agree not to misuse the platform, commit fraud, impersonate others, upload unlawful or infringing material, harass others, interfere with platform security, or use MyBlak for illegal activity.
9. Intellectual Property
MyBlak and its licensors own the platform, branding, interface, software, and original content. You retain ownership of content you upload, but you grant MyBlak the rights needed to host, display, reproduce, adapt, distribute, and promote that content in connection with the platform.
10. Suspension and Termination
We may suspend, restrict, or terminate access to the platform or a specific feature if we detect fraud, policy violations, non-compliance, safety risks, reputational risk, payment abuse, or legal/regulatory concerns.
11. Disclaimers
The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, MyBlak disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
12. Limitation of Liability
To the fullest extent permitted by law, MyBlak is not liable for indirect, incidental, consequential, exemplary, punitive, or special damages, including lost profits, lost revenue, lost goodwill, loss of data, personal injury, travel disruption, or third-party misconduct. Where liability cannot be excluded, MyBlak's aggregate liability shall be limited to the amount paid to MyBlak for the transaction giving rise to the claim, or the minimum required by applicable law.
13. Indemnity
You agree to indemnify and hold harmless MyBlak, its affiliates, officers, employees, contractors, and partners from claims, liabilities, damages, losses, and expenses arising out of your use of the platform, your violation of these Terms, your content, your listings, your services, or your conduct.
14. Governing Law and Disputes
These Terms are subject to the governing law and jurisdiction provisions stated in MyBlak's jurisdiction clauses and any mandatory consumer protections that apply in your country or region.
15. Updates to These Terms
We may update these Terms from time to time. If we make material changes, we may notify you through the platform, by email, or through updated acceptance prompts. Continued use of the platform after the effective date of revised Terms constitutes acceptance.
